Please see below for the Release and Waiver of Liability for the Green River Takeover taking place on August 28, 2021. The Green River Takeover is an at your own risk event which is organized by Action Learning Adventures LLC. In order to participate, you will be asked to sign and agree to the following:
RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY (“AGREEMENT”)
The Green River Takeover is an at your own risk event which is organized by Action Learning Adventures LLC. In consideration of being permitted to participate in The Women’s Green River Takeover, I, on behalf of myself, my children, my parents, my heirs, assigns, personal representative and estate hereby agree to release and discharge Action Learning Adventures LLC, Laura Farrell, Emily Shanblatt, all volunteers, all sponsors, all public entities, and Green River Access Fund as follows:
Identification of Risk
I acknowledge that kayaking the Green River is exceedingly dangerous and that other participants may jeopardize my safety. This event includes known and unanticipated risks which could result in physical or emotional injury, paralysis, death, or damage to myself, to my property, or to third parties. The kayaking risks include, among other things: paralysis; hypothermia; accidental drowning; sprains, strains, joint dislocations and broken bones; falling from high places; the negligence of other participants; boat pinnings; foot or other bodily entrapments; facial or other lacerations; impalement; extensive dental damage; and death.
Assumption of Risk
I expressly agree and promise to accept and assume all of the risks existing in this activity. My participation in this activity is purely voluntary, and I elect to participate in spite of the risks. I am in good health and proper physical condition to participate. I certify that I have run the Green River before (and specifically have run the section I am paddling during the event), that I am confident in my ability to paddle said section of the Green River, and I have knowledge of the danger of this section of river.
Waiver
I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless Action Learning Adventures LLC, Laura Farrell, Emily Shanblatt, Jamie O’Donnell all volunteers, all sponsors, all public entities, and Green River Access Fund from any and all claims, demands, or causes of action, which are in any way connected with my participation in this activity. Should there be any attorney’s fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all costs.
Insurance
I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I have no medical or physical conditions, which could interfere with my safety in this activity, or else I am willing to assume–and bear the cost of–all risks that may be created, directly or indirectly, by any such condition.
